(A) A person shall not operate a motor vehicle or a bicycle on a street, sidewalk or trail while using a hand or hands to operate or hold a device to communicate, play a game, or view a screen, while the motor vehicle or bicycle is in motion. This includes but is not limited to:

(1) Holding a cell phone to communicate by speaking or listening; or

(2) Using a hand-held keypad or hand-held screen to communicate by writing, texting, or reading; or

(3) Using a hand-held screen or other hand-held electronic device to play a game, be connected to the internet, or otherwise view a hand-held screen.

(B) This section does not apply to the following:

(1) Use of communication device as part of the official duties of law enforcement and public safety personnel.

(2) Use of communication device as part of the official duties of emergency vehicle drivers.

(3) Operation of an amateur radio by a person who holds a valid amateur radio license issued by the Federal Communications Commission and who is acting under the direction of authorized first responders in the event of an emergency.

(4) Use of a communication device for the purpose of communicating an ongoing medical emergency or to prevent violent crime.

(5) Use of communication device used by a “shipper,” “manufacturer,” or “motor carrier” as these terms are defined by A.R.S. § 28-5201. This exception does not prevent nor limit enforcement of safety violations applicable to a “shipper,” “manufacturer,” or “motor carrier.” (Ord. 336 § 1, passed 2-25-2015. Code 2012 § 76.01.)
